1 Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you (whether personally or on behalf of an entity, "Client" or "User") and Web999 Solutions ("Web999", "we", "us", or "our"), governing your access to and use of our website (https://web999.in) and all related services.
By purchasing any service, engaging in a contract, paying an invoice, or browsing our website, you expressly agree to abide by these Terms. If you disagree with any part of these terms, you must discontinue service engagement immediately.
2 Scope of Services
Web999 provides professional IT and digital solutions, including but not limited to:
- Website Design & Development: Static websites, dynamic CMS portals (WordPress), and eCommerce stores (WooCommerce, Shopify).
- Web Hosting & Server Services: Shared hosting, SSD cloud servers, SSL setup, and email hosting.
- Search Engine Optimization (SEO): On-page SEO, technical optimization, high DA backlink building, and local Google Map ranking.
- Pay-Per-Click Advertising (PPC): Google Search Ads, Display Ads, and Meta (Facebook/Instagram) advertising campaigns.
- Graphic Design & Branding: Vector logo creation, brochures, banners, and corporate identity design.
Specific project milestones, features, and pricing are defined individually in mutual proposals, invoices, or statements of work (SOW).
3 Client Responsibilities & Content Submissions
To ensure timely and satisfactory delivery of digital projects, the Client agrees to:
- Provide all requisite content, logos, images, text, and technical credentials in a timely manner.
- Ensure that all materials provided are owned by the Client and do not infringe upon any third-party copyrights, trademarks, or intellectual property rights.
- Review deliverables promptly and provide consolidated feedback within 7 business days of milestone submissions.
- Maintain confidential custody of administrative credentials (cPanel, WordPress logins) once handed over.
4 Payments, Invoicing & Refund Policy
We believe in 100% financial transparency. Our commercial terms are outlined below:
- Advance Deposits: Custom development projects generally require a 50% upfront commitment deposit before work commences, with the remainder payable upon design completion or prior to live server deployment.
- Applicable Taxes: Invoices are subject to statutory GST as mandated by the Government of India.
- Third-Party Costs (Domains & Licences): Domain name registrations, third-party premium plugins, paid themes, and API licenses are 100% non-refundable once registered with the respective authority.
- Project Cancellation Refunds: In the event of a client-initiated cancellation prior to project delivery, the advance deposit covers billable hours, research, and resource allocation and is strictly non-refundable.
5 Intellectual Property & Ownership
Upon receipt of 100% full and final payment, ownership of the finalized front-end website designs, customized graphical artwork, and written content transfers to the Client.
Portfolio Display Rights: Unless explicitly restricted by an executed Non-Disclosure Agreement (NDA), Web999 reserves the right to display the completed website design and mention the Client's brand name in our design portfolio, case studies, and marketing collateral as proof of work.
6 Web Hosting & Domain Name Policies
Timely Renewals are Critical
Domain names and hosting packages expire exactly 365 days from the purchase date. Failure to renew before expiration may cause immediate website suspension, email interruption, or loss of domain ownership to public auctions.
While Web999 partners with high-grade tier-4 SSD datacenters providing 99.9% uptime, we are not liable for temporary service interruptions caused by global telecom blackouts, upstream server maintenance, DDoS attacks, or third-party DNS propagation delays.
7 SEO & Digital Marketing Performance Disclaimer
Web999 implements verified, industry-standard, 100% White-Hat SEO techniques and Google-compliant advertising strategies.
Google Ranking Disclaimer: Google updates its core search ranking algorithms hundreds of times annually. While we have a verified track record of achieving top page results, no agency can guarantee a permanent #1 position on Google search. Search engine rankings depend on competition, algorithm shifts, and market factors beyond direct human control.
For Google Ads (PPC) and Social Media Marketing (SMM), advertising budgets are paid directly to Google or Meta platforms. Web999 charges solely for campaign optimization, conversion tracking setup, and account management services.
8 Limitation of Liability & Indemnity
In no event shall Web999, its directors, developers, or affiliates be liable for any indirect, consequential, incidental, or punitive damages, including loss of profits, data corruption, or business interruption arising out of the use or inability to use our website or services.
The total liability of Web999 for any claim arising under these terms shall not exceed the total amount paid by the Client to Web999 for the specific service in dispute during the preceding three (3) months.
9 Project Termination & Dormancy Policy
Either party may terminate a project agreement upon written notice if the other party breaches any material term and fails to remedy it within 14 business days.
Dormant Projects: If a project is stalled for more than 45 consecutive days due to client non-responsiveness or failure to provide required assets, Web999 reserves the right to archive the project. Re-activating an archived project may incur a nominal reactivation fee.
10 Governing Law, Jurisdiction & Contact
These Terms shall be governed by, and construed in accordance with, the laws of the Republic of India. Any dispute, legal proceeding, or claim arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Gujarat, India.
